📢 A Facebook Contest launched by a deputy

On January 28, 2025, a Hungarian MP launched a Facebook beauty contest for pregnant women titled “The Blessing of a Child.”

📸 Participants were required to submit photos, which could include other family members.
A photo of a relative could even be submitted in secret!

⚖️ The contest rules did not mention any information regarding data processing, retention, or the rights of the individuals concerned.

🚨 The Hungarian data protection authority ruled that this contest was not compliant with the GDPR and demanded the immediate cessation of unlawful data processing.

⚠️ Key GDPR Violations

1️⃣ Lack of Transparency

·       📌 No clear information provided to participants or individuals appearing in the photos.

·       📌 No possibility for the individuals concerned to object to the use of their image.

·       📌 Consent was not obtained from individuals in the photos, despite being mandatory.

2️⃣ Unlawful Legal Basis for Data Processing

·       📌 The candidate’s consent does not replace the consent of the individuals in the photo.

·       📌 The interests of the organizers or participants do not justify this data processing.

   📌 The processing lacks a valid legal basis             under the GDPR.
