🇸🇮 Video Surveillance: No Employee Monitoring and Live Image Broadcasting 🇸🇮
Continuous video surveillance of a pizzeria kitchen
👁️ Facts:
The Slovenian Supervisory Authority (SA) conducted an investigation in 2023 at a DODO PIZZA pizzeria in Slovenia.
The investigation revealed:
- Illegal surveillance of employees in the restaurant kitchen via video surveillance cameras.
- Illegal live broadcasting of these images on the company’s website.
⚠️ Violations:
- 📹 Illegal installation of surveillance cameras in the workplace (kitchen).
- Such monitoring is only allowed in exceptional cases and when it is strictly necessary for the safety of people or property.
📜 Reminder of video surveillance rules by the CNIL:
- The system must not be used to monitor employees’ work performance.
- Recorded footage must not be freely accessible to all employees or customers.
👉 Only security officers, security agents, or management should have access to the footage.
🔍 Violation of Article 6 of the GDPR:
- Absence of a legal basis for live video broadcasting.
- Legitimate interest not justified for such surveillance, which was deemed illegal under national law.
📄 Violation of Article 13 of the GDPR:
- Failure to inform employees concerned.
💸 Consequences:
- October 6, 2024: Administrative fine of €25,000.
- 🛑 Public sanction: Damage to the company’s reputation.
